The State of Montana is inviting the public to comment on the proposed Butte Priority Soils Operable Unit (BPSOU ) Consent Decree as part of the Silver Bow Creek Butte Area Superfund Site. The proposed BPSOU Consent Decree is a legal document that provides the framework for the continued cleanup of mining-related contamination to protect public health and the environment in Butte and Walkerville. The Consent Decree also requires Atlantic Richfield to provide financial assurances for future cleanup actions.

The State of Montana has reserved the right to withdraw or withhold its consent to the proposed Consent Decree if the public comments disclose facts or considerations that indicate this proposed settlement is inappropriate, improper, or inadequate.

Public comments will be accepted from June 15 to July 14, 2020

To be guaranteed consideration, written comments must be postmarked on or before 11:59 p.m., Tuesday, July 14, 2020. The Board of Environmental Review is seeking comment on a proposed rule (NEW RULE I) which addresses nonanthropogenic and natural water quality standards, including site-specific arsenic standards for segments of the Yellowstone River. Natural or nonanthropogenic water quality standards are established because natural or nonanthropogenic effects on the landscape have resulted in concentrations in state surface waters that naturally exceed the otherwise applicable state water quality standards.

The Federal Clean Water Act requires that states review their water quality standards every three years and solicit input on the need for revising or adding to state standards. The review helps set priorities and a work plan for water quality standards development and telemarketing. On February 12, 2020, Montana opened water quality standards for public review and comment,. This open comment period will end on June 10, 2020. You are invited to submit data, views, or arguments concerning water quality standards either orally or in writing at the hearing.

DEQ is inviting public comment on proposed changes to the original cleanup plan at the Montana Pole & Treating Plant in Butte. A Draft Explanation of Significant Difference explains the proposed changes to the cleanup plan and explains why those changes are necessary. That Draft document will be available on Monday, February 10, 2020. The proposed changes establish more protective cleanup levels than those included in the Record of Decision.

DEQ is seeking public comment on a draft permit modification for the hazardous waste permit at the BNSF Railway Company former tie treating plant, Paradise, Montana. 

The draft hazardous waste permit modification includes removal of two permitted storage tanks, changing the creosote product recovery method to an air-lift pump recovery system, and modifying the groundwater monitoring program.

The Department proposes to add provisions related to the Regional Haze program in Montana into the SIP. Specifically, the Department proposes to include orders approved by the Montana Board of Environmental Review incorporating emission limits for four facilities identified in the Regional Haze Federal Implementation Plan (FIP) into the Montana SIP.
