In accordance with 17.55.114(6) of the Administrative Rules of Montana (ARM), the Montana Department of Environmental Quality (DEQ) hereby gives notice of a 30-day public comment period on its proposal to delist the Montana Rail Link (MRL) 1930 South Avenue West Facility, in Missoula, Montana. The City of Missoula has successfully completed a voluntary cleanup of this facility and DEQ is soliciting public comment on the proposed delisting of this facility.  DEQ has determined that through this voluntary cleanup, the City of Missoula has completed all remedial action required for the facility.  Thus, upon payment of all remedial action costs, all the requirements of the Comprehensive Environmental Cleanup and Responsibility Act (CECRA) will be fully met, including the requirement that conditions at the facility assure present and long-term protection of public health, safety and welfare and the environment.  Therefore, DEQ proposes to remove the facility from the CECRA priority list once closure is approved. 

The northern portion of the Facility contains the Johnson Street Community Center and other buildings, while the southern portion of the Facility is known as the MRL Park. Previous interim cleanup activities have occurred at the Facility to remove lead and other metals contamination in soils at what is now MRL Park, as well as construction of MRL Park itself. The VCP implemented excavation and offsite disposal at a permitted disposal facility of arsenic-contaminated soils at the base of one storm drain on the northern portion, and placement of institutional controls limiting use of the southern/MRL Park portion to recreational use (prohibits residential use).

The public comment period will begin on February 4, 2025 and comments must be received in the DEQ office by 11:59 PM on March 6, 2025.  Copies of the Voluntary Cleanup Plan are available at the Missoula Public Library located at 455 E. Main St in Missoula and copies of the Voluntary Cleanup Plan and other site-related documents are available at the DEQ State Superfund Unit of the Waste Management and Remediation Division office located at 1225 Cedar Street in Helena.
