Montana Department of Environmental Quality About Us Permitting & Operator Assistance Public Participation

Energy | Notice of Proposed Rulemaking | Comment Period Ends August 7, 2026

  • July 10 2026

As part of the Governor's Red Tape Relief Initiative, the department is proposing to address agency rules that are currently written at a high reading level and rules related to repealed statute. This review focuses on streamlining rule language, replacing out-of-date terminology, and repealing unnecessary or redundant rules. With this initiative, the department's goal is to improve the public's ability to understand the department's rules while maintaining rule language necessary to implement statute. Through this effort, the department will be proposing these changes through rulemaking efforts within each agency program, instead of a department-wide rulemaking.
