Rulemaking Background:

The Department of Environmental Quality (DEQ) is proposing several amendments to Title 17, chapter 74 of the Administrative Rules of Montana, pertaining to Title 75, chapter 10, part 13 Methamphetamine or Fentanyl Contamination – Indoor Property Decontamination Standards, Montana Code Annotated.

The rule amendment will update the methamphetamine cleanup rules to reflect changes from Senate Bill 201 that passed during the 2025 legislative session. These changes include adding a fentanyl decontamination standard, requiring contractor certification, and updating definitions.  Other proposed changes to the ARM are to streamline the rule language and make the format consistent which should improve readability and comprehension.
