The Department of Environmental Quality (DEQ) is proposing several amendments to Title 17, chapter 53 of the Administrative Rules of Montana (ARM), pertaining to Title 75, chapter 10, part 4 Hazardous Waste Management, Montana Code Annotated.

EPA periodically revises and corrects regulations governing the management of hazardous waste. Montana has been authorized by EPA to administer certain provisions of federal hazardous waste regulations and must update the department’s hazardous waste rules to reflect the most recent requirements to maintain its authorized status. The department has also determined that reasonable necessity exists to make minor amendments/repeals to the rules to enable the program to correct citations, effectively operate, and implement the federal and state regulatory obligations

Other proposed changes to the ARM are designed to streamline the rule language and make the format consistent, which should improve readability and increase comprehension for the public.

You are invited to submit data, views, or arguments in writing. Written data, views, or arguments may be submitted to the Department of Environmental Quality, and must be received no later than 5:00 p.m., June 19, 2026. 

If the department receives requests for a public hearing on the proposed rulemaking from either 10 percent or 25 people, whichever is less, of the persons directly affected by the proposed rulemaking; from the appropriate administrative rule review committee of the Legislature; from a governmental subdivision or agency; or from an association having not less than 25 members who will be directly affected, a hearing will be held.
