The Department of Environmental Quality proposes to amend ARM 17.8.1214 and ARM 17.8.1224 pertaining to the Removal of Affirmative Defense Provisions in Title V permits and Administrative Rules.

 

Background:

On July 12, 2023, the US Environmental Protection Agency (EPA) removed emergency Affirmative Defense provisions from the Clean Air Act (CAA) operating permit program (Title V). In response, Montana’s Department of Environmental Quality (DEQ) proposes to amend Administrative Rules of Montana (ARM) 17.8.1214 and 17.8.1224 pertaining to the removal of Affirmative Defense provisions in Title V permits and Administrative Rules.”
