Surface Water Discharge

The Montana Department of Environmental Quality has the responsibility to protect the public health and the environment by ensuring wastewater is properly handled and treated safely. Whenever a municipality, industry, or other entity wishes to discharge water to a surface water of the state, that entity must first obtain a permit from DEQ. Montana Pollutant Discharge Elimination System (MPDES) permits regulate wastewater discharges by limiting the quantities of pollutants to be discharged. The limits and/or requirements in the permit help ensure compliance with Montana’s Water Quality Standards, State and Federal Regulations, all of which were written to protect public health and the aquatic environment. The series of steps for a particular permit may vary somewhat depending on the size, nature, and complexity of the discharge.

Types of Permits

There are two types of Montana Pollutant Discharge Elimination System permits: Individual and General. An Individual MPDES permit is unique to each facility. The limitations and requirements in an Individual Permit are based on the facility's operations, type and amount of discharge, and the nature of the receiving stream, among other factors. Conversely, some point sources can be grouped under a category of sources that contain very similar or, in many cases, identical effluent limitations and requirements; their contents have been compiled into one permit, known as a General Permit.

Stormwater is rain and snow melt that runs off surfaces such as rooftops, paved streets, highways, and parking lots and that does not percolate into the soil. As water runs off these surfaces, it carries pollutants such as sediment, oil, fertilizers, pesticides, trash, animal waste and a variety of other pollutants that can negatively impact water quality. DEQ regulates discharges of stormwater from construction activity, industrial activity and from Municipal Separate Storm Sewer Systems (MS4s) primarily through three Montana Pollutant Discharge Elimination System (MPDES) General permits.

 

 

 

Montanans rely heavily on groundwater as the primary source of drinking water for many rural domestic water supplies as well as public water systems. Groundwater is also important for irrigation, livestock, and indirectly for thermoelectric power. Montana’s programs for the protection and remediation of groundwater are driven by the need to keep groundwater safe from contamination and to protect and support the current and future uses of groundwater

The Montana Groundwater Pollution Control System (MGWPCS) program issues groundwater discharge permits to owners of potential sources of pollution to state groundwater. Typical permitted facilities include residential wastewater treatment systems, metal ore mills, lumber mills, wood product manufacturers, breweries, and community water treatment plants.

The Montana Water Quality Act (§75-5-605 ) requires a valid permit for the following activities:

(a) construct, modify, or operate a disposal system that discharges into any state waters;

(b) construct or use any outlet for the discharge of sewage, industrial wastes, or other wastes into any state waters; or

(c) discharge sewage, industrial wastes, or other wastes into any state waters.

MGWPCS permits are for discharge to state groundwaters. They are not applicable for discharges occurring within the boundaries of federally recognized Indian Lands. MGWPCS permits may also not be applicable for discharges located near state surface waters. For additional information on surface water discharge permits, please refer to the Surface Water Discharge (MPDES) program.

An individual MGWPCS permit is a stand-alone permit issued for a site-specific activity. Each individual permit may differ as they are based on the specifics of each discharge site and of each proposed discharge activity.

Each individual permit is placed into a category based on the type of wastewater to be discharged; either domestic (e.g. sinks, toilets, showers) or non-domestic (industrial or other wastewater). Operator Assistance

In Montana, all drinking water treatment plants, wastewater treatment plants, or water distribution systems must be operated under the supervision of a fully certified operator to ensure the proper management, operation, and maintenance of the system. DEQ administers both the water and wastewater operator certification programs and provides testing and program information services to ensure comprehensive, ongoing training is provided to Montana’s water and wastewater operator community.

Compliance and reporting is critical to maintaining both Montana’s public water supply and the health of Montana lakes, rivers, streams and wetlands. DEQ conducts a variety of inspections and requires mandatory reporting to ensure compliance and protection of public health and Montana waters.

The purpose of a sanitary survey is to protect public health by ensuring a water system is able to consistently and reliably deliver an adequate quality and quantity of safe drinking water to the consumer and to maintain compliance with regulations.

To achieve this, the surveyor will evaluation eight key elements of a water system.

Eight Key Elements of a Sanitary Survey:

  • Source
  • Treatment
  • Distribution system
  • Finished water storage
  • Pumps, pump facilities, and controls
  • Monitoring, reporting, and data verification
  • System management and operation
  • Operator compliance with state requirements

In addition, technical assistance can be provided during the survey visit. This can be an opportunity to clarify proper monitoring and sampling requirements or procedures and be informed of any upcoming changes in regulations.

How Often are These Surveys Conducted?

Community Water Systems
At least every three years

Non-Transient Non-Community Water System
At least every five years

Transient Non-Community Water System
At least every five years

DEQ is authorized by state law to require compliance with environmental laws, federal regulations, and state rules regulating surface water discharge and storm water permits. Compliance activities include traditional enforcement methods, such as inspections and public complaint response, as well as technical assistance.

Noncompliance reporting is required when a permittee identifies condition(s) that are not in compliance with or when a permittee determines they will not be able to comply with a condition(s) of their permit. Examples of noncompliance include: any noncompliance that may endanger health or the environment; a discharge of pollutants from the construction project site to state waters; failure of installed Best Management Practices (BMPs); and failure to conduct inspections.

Timelines to Report Noncompliance

Permittees are required to adhere to the following oral and written reporting timelines.

24-Hour Notification

The permittee must provide an oral report to the Compliance Inspector within 24 hours of first identifying the noncompliance. If the event of noncompliance occurs on a weekend, leave a message on the Water Protection Bureau’s main number: (406) 444-5546 or the Water Quality Division line at (406) 444-6697.

Written Report

A written report must be submitted to the Compliance Inspector within five days of the discovery of noncompliance. The Discharge Permit Noncompliance Reporting Form must be completed and mailed to the address below within five days of the 24-hour oral report.

An unintentional discharge of raw sewage from a sanitary sewer (sanitary sewer overflow), which does not occur at the designated waste water treatment plant outfall, can seriously endanger public health and contaminate waters, causing serious water quality problems.

Timelines to Report Noncompliance

Permittees are required to adhere to the following oral and written reporting timelines.

24-Hour Notification

Information must be provided orally to the Department of Environmental Quality (DEQ) within 24 hours from the time the overflow was discovered. The 24-hour report of noncompliance must be made to the DEQ Water Protection Bureau at (406) 444-5546 or to the state Office of Disaster and Emergency services at (406) 841-3911.

Written Report

A written report must also be provided within five days from the time the overflow was discovered. All sanitary sewer overflows, no matter the circumstances or cause, must be reported to DEQ, even if you do not believe a violation has occurred.
