Laws and Regulations
The Montana Hazardous Waste Act (MHWA) is the Montana equivalent of the federal Resource Conservation and Recovery Act (RCRA). MHWA and RCRA are state and federal laws that govern proper management and disposal of hazardous waste, including permit requirements for certain treatment, storage, and disposal activities.
Onyx Environmental Hazardous Waste Storage Permit
In 1992, Advanced Environmental Technical Services (AETS) was issued an operating permit for storage of hazardous waste at their facility in Rocker, Montana. AETS intended to build an intermediate transfer station for consolidating and treating wastes prior to off-site disposal. The hazardous waste permit was transferred to Onyx Environmental Services, LLC when Onyx purchased AETS and the Rocker facility.
The intermediate transfer station was never constructed. Onyx did not request renewal of the hazardous waste permit, which then expired in 2002.
