Board of Environmental Review

In Chapter 418, Laws of 1995 (SB 234), the Legislature created the Department of Environmental Quality and the Board of Environmental Review, and gave each specific duties under various environmental regulatory statutes. Included in these pages is a listing of those statutes and a brief description of the Board's role and responsibilities under those statutes.

The Board of Environmental Review teleconference scheduled for Wednesday, May 14, has been cancelled due to scheduling conflicts. As a follow up to its hearing on April 21, 2008, the teleconference had been scheduled for the Board to adopt factual findings, legal conclusions, and a final order remanding Permit No. 3423-00, issued to Southern Montana Electric for its Highwood Generating Station. The remand is to require another Best Available Control Technology analysis.

The Board will act on this item at its next regularly scheduled meeting Friday, May 30 in Helena.
