Chicago Milwaukee Corporation (CMC) Bozeman Asbestos Facility

Background

CMC Asbestos Bozeman (the Facility), at the 600 block of East Main Street in downtown Bozeman, is a former asbestos ore-loading location, which operated from 1953 to circa 1960. Recycling/salvage businesses also operated at the Facility from 1956 to 1988. Soils at the Facility were historically contaminated with asbestos from the ore-loading operations. Contaminants also included heavy metals, polychlorinated biphenyls (PCBs), dioxins/dibenzofurans, and organic compounds (including petroleum) from the salvage operations. Soils containing the latter contaminants and any accessible asbestos-ore have since been removed under a voluntary cleanup plan, pursuant to the Voluntary Cleanup and Redevelopment Act, §§ 75-10-730 through 75-10-738, MCA.

The asbestos ore at the Facility originated from the Karst Mine near Big Sky and was stockpiled at the location of a mill on Wallace Avenue. Ore insulation processed at the mine and at the Bozeman mill, called “Karstolite,” was used as insulation material and has been found in attics and walls of some buildings in Bozeman, Helena and Livingston.

In the fall of 2001, the City of Bozeman purchased 14 acres of the Facility from CMC and remediation work on City-owned property was completed in October 2003. Accessible asbestos-ore contaminated soils on properties adjacent to the 14-acre City property were excavated in the spring of 2009. Where inaccessible ore-contaminated soils remain in place (for example beneath buildings) institutional control measures such as deed restrictions have been placed on the properties to ensure proper removal and disposal of any asbestos contamination in the future.

The City of Bozeman, having agreed to act as the lead potentially liable person (PLP) under the Controlled Allocation of Liability Act (CALA) to complete the required remedial actions at the Facility, has been reimbursed by DEQ for 79% of the costs to cleanup the Facility from the State’s orphan share fund.
