Summary of Requirements for Conditionally Exempt Small Quantity Hazardous Waste Generators

1. In order for hazardous waste generators to qualify for "conditionally exempt small quantity generator" status, all of the following criteria must be met:

  • No more than 220 pounds of hazardous waste may be generated within any calendar month;
  • No more than 2200 pounds of hazardous waste may be accumulated at any one time;
  • No more than 2.2 pounds of acute hazardous waste, or 220 pounds of soil contaminated from an acute hazardous waste spill, may be generated or accumulated at any one time.

2. Conditionally exempt small generators are required to comply with the following requirements:

  • Must determine which of the wastes they generate are hazardous;
  • Keep records of any test results, waste analysis or other determinations used to characterize  hazardous waste for at least three years from the date of final disposition of the waste;
  • Dispose of hazardous waste only at:
    • A legitimate recycling facility;
    • A permitted Hazardous Waste Treatment, Storage, or Disposal Facility (contact this office for a list of facilities in the vicinity of Montana);
    • A licensed Class II sanitary landfill (only if the waste is in a solid state and the owner/operator of the landfill agrees to accept the waste).
